CALL TO ORDER

The meeting was called to order by President Goold. Board Members Present: Engellenner, Goold, Granados, Jones, Stewart, Trujillo, Valley, Vanderveen; Fire Chief Martinez, General Counsel Price, Board Clerk Tilson. Director Horel, absent.

PLEDGE OF ALLEGIANCE

AWARDS:

a. Life Saving Commendation-Molly Barth-(Martinez)
[Item considered after Protective Ensemble Demonstration, followed by a brief recess at 6:25 p.m.]

Molly Barth, a nine-year old, received a Life Saving Commendation plaque from Fire Chief Martinez in recognition of her heroic actions on March 23, 2002 in providing help to her mother, Liz Barth, who suffered a diabetic seizure while driving. Her rapid actions resulted in Fire personnel arriving at the scene and a positive outcome to a life-threatening situation. A Sacramento Metropolitan Fire District baseball cap and tee shirt were also presented.

President Goold recommended Molly receive an Honorary EMT Certificate.

b. Commendation-Explorer Cadet Program-(Martinez)

Firefighter Maurice Johnson, Explorer Cadet Program Manager, accepted a Certificate of Commendation from Fire Chief Martinez on behalf of all the members of the Explorers in recognition of their outstanding dedication to the Sacramento Metropolitan Fire District and meritorious community service.


FIREFIGHTING PROTECTIVE ENSEMBLE

Safety Captain Mike McKenna demonstrated the effectiveness of the protective ensemble used by Sacramento Metropolitan Fire District as illustrated by a recent fire-fighting incident involving Firefighter/Paramedic Brian Swindler. The protective clothing and safety equipment shown were severely damaged but prevented life threatening injury to Mr. Swindler.

Director Trujillo requested this item on the agenda. Following a demonstration of the incident, he felt assured that our people are protected. This also presents a good position for purchasing thermal imaging equipment.

ACTION ITEM(S)

1. Appeal of Fire Prevention Bureau Decision-Slavic Missionary
Church @ 9880 Jackson Highway, Sacramento-(Price)

§ Five-page legal opinion from District General Counsel Price dated June 17, 2002 relative to the Certificates of Occupancy pertaining to the Bethany Slavic Missionary Church distributed to the Board

Ø Certificate of Occupancy originally issued to the Sports Complex in 1987 for Building "C" is not valid for the Church's current use as a sanctuary-requires a Certificate of Occupancy for the new use

Ø The building in its present physical configuration does not comply with the California Building Code exiting requirements

§ Supplemental information from Attorney Mark Pruner dated June 14, 2002 distributed to the Board on behalf of the Slavic Missionary Church appeal, with photographs of the main exit to the Church and traffic flow.


§ Three-page staff report with attachments dated June 5, 2002 recommending the actions of the Fire Chief be sustained, continue to provide him/designee the authority to enforce the Fire and Life Safety Code, and deny the appeal.

§ Fire Marshal Dobson maintained the District's position that the Church apply for a building permit, complete the work required, and receive a new Certificate of Occupancy

§ Attorney Pruner presented a video illustrating the ingress and egress traffic flow to the main entrance of the Church

· Approximately 1700-1800 people at the first service on Sunday--the current exiting requirements without any change allow 1,430
· The use triggers the exiting requirements and maintained no change in the use-it remains an assembly use

Requested consideration of the following:
a. Allow a deadline of July 5 to submit building plans as committed to in the paperwork presented
b. Allow the 1,430 people to meet in the main structure
c. Allow the on-site school in Building "B" to exist

§ The District recognizes and supports the needs of the community and will continue to work with the Church

· Board Action:
Engellenner/Stewart-Deny the appeal. Unanimous vote in favor by members present. Director Horel, absent.

2. Resolution No. 15-02 Calling for Election-Placer County-(Price)

§ Resolution No. 15-02 calling for the General District Election in Placer County and requesting consolidation with the statewide election on November 5, 2002 was recommended for adoption.

· Board Action:
Stewart/Granados-Adopt Resolution No. 15-02. Unanimous vote in favor by members present. Director Horel, absent.

3. Military Leave Policy-(Means)

§ Board action taken on December 12, 2001, provides total coverage for any affected employee.

Item tabled pending proposed State legislation.

4. California Special Districts Association (CSDA)-Board of Directors-(Martinez)

· Board Action:
General consensus in support of incumbent, Rita Velasquez, General Manager of the Elk Grove CSD, for another term on the Board of Directors for Region 2 of the CSDA.

PRESENTATION ITEM(S)

1. Pioneer Mutual Hook & Ladder Society-(Crooks)

§ Richard Crooks presented a historical background of the Pioneer Mutual Hook & Ladder Society founded to establish a fire museum in Sacramento, with an update on its current activities.

Current membership of 660. Funding is provided through payroll deductions, donations, memorial contributions, and various fundraising activities; the deposit account now contains over $200,000. Distributed a membership/payroll deduction form to the Board with copies available.

He thanked Fire Chief Martinez for his continued support throughout the years.

§ Fire Chief Martinez expressed his personal appreciation to Mr. Crooks for his support of the District and the community fire service. His contributions include a map of all predecessor agencies, District chronicle, and badge display in the lobby. Currently working on a display, "The Last Alarm," containing a plaque in recognition of named firefighters of our predecessor agencies who gave their lives and some veteran fire protective equipment.

Encouraged membership in the Mutual Hook & Ladder Society for $2 per month.

PRESIDENT'S REPORT-(Goold) None

FIRE CHIEF'S REPORT-(Martinez)

§ Fire Camp 2002 commenced Tuesday, June 18, with 92 young people attending and a number of volunteers; concluding on Saturday, June 22.

Acknowledged Battalion Chief Geoff Miller as the coordinator and Fire Camp leader. List of employees contributing their off-time to this event will be forwarded at completion.

§ Firefighter oral board entry testing in progress with 298 applicants; concludes Friday.

§ Displayed a large replica of the New Heroes of 2001 Semi postal Stamp. An official unveiling ceremony of the fundraising stamp will be held on Friday, June 28 at 11 a.m., Firefighter's Memorial in Capitol Park.

§ Fire Marshal Dobson presented a brief overview of the recent serial fires; provided background on three significant serial fire arrests in the last six weeks. Emphasized the continued importance of the arson investigation program in providing service to the entire County; without it, the three arrests would not have occurred.

§ May not be in attendance at the July 10 Board meeting.

Report by General Counsel Price:

1. CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION Pursuant to California Government Code Section 54956.9(a)-One Case

William Brown vs. Sacramento County Fire Protection District

Counsel Price reported that the District's Workers' Compensation counsel, Douglas Weill, provided the Board with an update and recommendation on potential settlement. The Board by an 8-0 vote provided direction to Mr. Weill. The details of a settlement will be made public if effectuated. No further action was taken in Closed Session.

BOARD MEMBER QUESTIONS AND COMMENTS

Vanderveen:
§ Action was taken at the last Board meeting on the hiring categories of our employees. Some ambiguity may exist relative to the authority to execute those employments. Recommended issue be referred back to the Policy Committee in concert with staff to bring back any further amplification, if appropriate.



Trujillo:
§ Out-of-State and not in attendance at the next meetings of the Policy Committee and Board [July 10].

§ Participated in a ride-along on three calls with Captain Tom Hansen and Engineer Jim Van Brunt of Station 23. Great response time of 4-5 minutes each, performed by personnel with expertise.

Jones:
§ Encouraged Board Directors not currently signed up to become a member of Pioneer Mutual Hook & Ladder Society. Establishment of a museum will contribute to the historical significance of our area.

§ Fire Chief Martinez will be speaking at the Cordova Community Council this Friday; unable to attend due to work commitment but wished him well.

Granados:
§ Commended Fire Marshal Dobson and staff for an outstanding job on the Slavic Church issue, with work continuing.

This Department deals daily with issues that save a lot of lives.

Engellenner:
§ Inquired about status of negotiations with Sacramento County for the International Airport in light of their hiring process for a fire chief.

Fire Chief Martinez stated the hiring process is on hold until we reach a conclusion.

Goold:
§ Fire Chief Martinez was the keynote speaker at the American River College graduation this semester and did a fine job representing our District.
