CALL TO ORDER
President Goold called
the meeting to order. Board Members Present: Duveneck, Engellenner,
Goold, Granados [arrived 2:38 p.m.],
Jones, Stewart, Trujillo, Valley, Vanderveen; General Counsel Price, Board
Clerk Tilson.
PUBLIC OPPORTUNITY TO DISCUSS MATTERS OF
PUBLIC INTEREST WITHIN DISTRICT JURISDICTION ON ITEM(S) SCHEDULED ON THE
AGENDA:
Captain
Pat Monahan, Vice President of Firefighters Local 522, thanked the Board
for conducting a special session on the issue of the Employee-Employer
Relations Resolution (EERR). He informed the Board that he provided a
tape of his radio interview yesterday with Steve Milne to a Board member.
The media contacted the Local and the interview contained no reference to
sensitive issues proposed in the EERR document or negative criticism
toward the District. Their intent is to adhere strictly to the
negotiation process and the parameters set forth by the Board. It is
understood that Local 522 labor counsel present tonight cannot speak in
the Closed Session.
Director Granados
arrived at 2:38 p.m.
Counsel
Price stated the provisions of The Brown Act relating to labor relations
are very specific. The Board may meet in Closed Session with only its
designated representatives regarding labor negotiations. There is no
provision in The Brown Act for dialogue with labor counsel in Closed
Session. A specific legal issue, SB 402 or binding arbitration in this
case, may be discussed in open session, but it is not permissible to have
individuals other than the Board’s designated representatives in the
Closed Session.
Director Trujillo
stated the interview tape he listened to is available. In his opinion, it
contained no reference to negotiations and only praise for the District,
the Board, and Local 522.
Mr. Monahan introduced Alan Davis, Local 522’s
legal advisor on the issues.

District representatives regarding negotiations over the new
Employee-Employer Relations Resolution (EERR) for the District and
provided direction—no further action.
